The use of Pascal SIMON’s website for the sale of Visual Content implies the full and complete acceptance of the following general conditions of sale (GCS). Pascal SIMON reserves the right to modify the GCU at any time, so you, the users of the site are invited to consult them regularly.
When you purchase Visual Content (such as a photo), you are in fact purchasing a license to use the Visual Content. This license allows you to download Visual Content, such as a photo, and use the Visual Content. No other person can access your account or use the Visual Content for which you have purchased a license.
Every minor must have written consent from his or her legal guardian in order to distribute the photographs.
The assignment of reproduction rights is expressly subject to the provisions of the Intellectual Property Code. The Content offered on the Pascal SIMON website is its full property, the Customer can only acquire the right of reproduction and/or representation. The assignment of reproduction and/or representation rights is never granted exclusively. Exclusivity can only result from a specific written agreement and results in the settlement of rights due under exclusivity, distinct from the law of the standard license. Pascal SIMON’s standard license grants you a non-exclusive, non-transferable right to use, modify (except as expressly prohibited herein) and reproduce Visual Content internationally, in perpetuity, to the fullest extent permitted by the applicable license and subject to the restrictions set forth herein.
With the STANDARD LICENSE (for individuals) that comes with Pascal SIMON's photos by default, you can:
・ publish the file on a website or social networking site without any limitation of views;
・ Use the file as a wallpaper for your computers, tablets and smartphones, cropping them yourself if the need arises;
・ print the file for you and your immediate family (family setting);
With the STANDARD LICENSE (for individuals) that comes with Pascal SIMON's photos by default, you cannot:
・ distribute or sell the stand-alone file, even if modified;
・ transfer or sell any license to a third party, individual, semi-pro or pro.
・ create goods, models or other products for resale or distribution if the primary value of the product is associated with the file itself. For example, you cannot use the file to create a poster, t-shirt, or mug that the user might buy only because of the file printed on it.
With the PRO/SEMI-PRO LICENSE that is offered and billed on this site (for each image), you can use commercially or promotional, the photos concerned, strictly following the uses for which you have subscribed, without interpreting them. Please contact the right holders in case of doubt or misunderstanding.
This PRO/SEMI-PRO LICENSE is not transferable, assignable or sellable to any particular, semi-pro or pro third party without the clear agreement of the rights holders.
License Payment:
Authorization for the use of Visual Content shall be granted only after the actual payment of the fees for such Content. Consequently, no exploitation of Visual Content may be carried out without payment of the corresponding fees. In the event of non-effective payment, the concession will be automatically resolved and the reproduction or representation thus made will constitute an infringement of the rights of Pascal SIMON and the author of the Visual Content.
Taxes: If Pascal SIMON is required to collect certain indirect and/or transactional taxes (e.g. sales tax, value added tax, goods and services tax and others) under the laws of your state or country of residence, you are required to pay these indirect taxes. If Pascal SIMON or you have to collect or remit indirect or indirect taxes, you may be asked to assess the tax yourself under the laws applicable in your country of residence.
Mandatory:
Regardless of the use or format of the Visual Content, the words "© Pascal SIMON - psimon.fr" are mandatory, affixed adjacent to the Visual Content, in the context of its use. These markings shall be of a size, color and size that enable them to be clearly and easily read by the naked eye.
